These Terms of Service (“Terms”) constitute a legally binding agreement between you (“you,” “user,” or “Customer”) and John Business Services Pvt Ltd (“Company,” “we,” “our,” or “us”) governing your access to and use of our freight brokerage, logistics coordination, and supply chain management services (“Services”), including but not limited to our website, client portals, mobile applications, and communication platforms (collectively, the “Platform”).

By using our Services, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not accept these Terms, you may not use ourServices.

1. Scope of Services

John Business Services Pvt Ltd provides logistics and freight brokerage services including but not limited to:
● Load booking and carrier coordination
● Shipper and consignee communication
● Freight rate quoting
● Real-time tracking and visibility tools
● Carrier and vendor onboarding and compliance
● Document and invoice management
● Software and support for logistics operations

We act as a licensed freight broker, not as a motor carrier. We do not own or operate transportation vehicles and act solely as an intermediary between shippers and third-party carriers.

2. Customer Responsibilities

As a user or client of our Services, you agree to:
● Provide accurate, complete, and up-to-date information for all bookings and documentation
● Ensure that freight is properly packaged, labeled, and compliant with applicable transport laws
● Comply with all local, state, federal, and international laws and regulations governing freight and logistics
● Not use the Services for illegal, prohibited, or unsafe shipments (e.g., hazardous goods unless properly declared)
● Cooperate promptly for any information or documentation requests necessary for compliance or carrier coordination

You remain responsible for the accuracy of all load details, delivery addresses, and consignee information provided to us.

3. Carrier & Vendor Relationships

We engage independent third-party carriers and logistics providers. While we perform due diligence on carriers (e.g., insurance, operating authority), we are not responsible for:
● Delays caused by traffic, weather, labor shortages, or carrier negligence
● Cargo loss, theft, or damage unless otherwise covered under relevant insurance or contractual terms
● Acts beyond our control including Force Majeure (see Section 11)

All claims related to cargo damage, loss, or delay must be filed in accordance with applicable law and insurance terms.

4. Rates, Quotes, and Payments

● All rates are based on provided shipment data. If any inaccuracies are discovered (e.g., weight, dimensions, accessorial services), we reserve the right to adjust charges.
● Rate quotes are subject to carrier availability at time of booking.
● Invoices are due as per agreed payment terms, typically net 15 or net 30 days from the date of invoice unless otherwise specified.

● We reserve the right to suspend services for accounts in arrears.

Payments are accepted through secure payment methods, and all billing is conducted in the agreed-upon currency.

5. Insurance & Claims

We do not automatically insure freight unless explicitly agreed. Cargo is generally covered under the carrier’s liability insurance as per regulatory requirements (e.g., FMCSA in the U.S., IRDAI in India).
Claims must be:
● Filed in writing within 7 days for visible loss/damage
● Filed within 21 days for concealed loss/damage
● Supported by a signed Proof of Delivery (POD), photos, and inspection report

We will assist with filing claims but are not responsible for denial by the carrier or insurer

6. Platform Access & Security

You may be issued access credentials to our online Platform. You agree to:
● Keep login details confidential
● Notify us of any unauthorized access or breach
● Not engage in scraping, reverse engineering, or unauthorized API access
● Use the Platform in accordance with applicable usage policies and guidelines

We reserve the right to suspend or restrict access in case of misuse, fraud, or security risks.

7. Data Privacy & Confidentiality

Our handling of your personal and business data is governed by our [Privacy Policy].

● Reproduce or sublicense our technology
● Remove or obscure copyright or proprietary notices
● Use our content to develop competing services

9. Warranties & Disclaimers

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including:

10. Limitation of Liability

Either party may terminate this agreement with 30 days’ written notice unless otherwise specified in a signed contract. We may immediately terminate or suspend your use of the Services for:
● Fraud or misuse
● Legal or regulatory violations

13. Governing Law & Jurisdiction
